There are two types of courts in the UAE, ie, federal (the Emirates of Abu Dhabi, Sharjah, Fujairah, Ajman, and Umm Al Quwain) and local (the Emirates of Dubai and Ras Al Khaimah, which have retained their independent judiciaries). Both federal and local courts comply with the UAE Temporary Constitution of 1972. Both federal and local court systems are composed of three levels, ie, courts of first instance, courts of appeal, and the Federal High Court in Abu Dhabi or the Court of Cassation in the Emirate of Dubai. In the Emirate of Ras Al Khaimah, the judiciary is of two levels only, ie, courts of first instance and a court of appeal.

The Civil Procedure Act regulates the jurisdiction of the federal courts, their formation, and level in the hierarchy. The Act is applicable to all civil proceedings before the courts, ie, civil, commercial, and personal. Although the courts in the Emirate of Dubai are formed under and regulated by Act Number 3 of 1992, the Civil Procedure Act has been adopted and enforced in Dubai pursuant to Act Number 5 of 1992.

The hospital your baby is delivered in will issue a ‘notification of birth certificate’ in Arabic. All expatriates must get both the Arabic and English certificate attested by the Ministry of Health (at Al Baraha Hospital) and Ministry of Foreign Affairs.

Documents Required:

Procedure:

* Some public hospitals such as Dubai Hospital (04-7075805), Rashid Hospital (04-3371111) and Al Wasl Hospital (04-3241111) have a counter which will issue the Arabic birth certificate. Go there and hand over the documents and receive the Arabic birth certificate immediately.

* For an English birth certificate, go to Preventive Medicine Department at Al Baraha Hospital (also known as Kuwaiti Hospital 04-2710000).

* Get an application form from the Birth Certificate Office. A translator will type your application at the hospital. You can get it attested at the Ministry of Health Counter at Al Baraha Hospital itself.

* Take the documents to the Ministry of Foreign Affairs for attestation.

There is a private company called Medi Express (04-2727772, open till 7 pm), at the Al Baraha Hospital Compound, who can handle all translation and attestations.

After the birth of your child, do not rush to get the birth certificate. Wait till your wife and child have been discharged from the hospital and you have had a few days time to finalize a name for your child, before you proceed to get the birth certificate. However, do keep in mind that the maximum period to register your child’s birth is 30 days.

You must have a valid health card in order to deliver in a public hospital. Please carry your original marriage certificate & passports with you.

What are the procedures of Employment Visa cancellation in Dubai?

STEPS TO FOLLOW

1. Type application forms. Put company seal and signature of the sponsor on Immigration application. On labour form signature of the sponsor will come through E-signature card punching.

2. Employee’s signature required on labour application under his statement I certify that i received all my dues and entitlements.

NOTE: Employee should not sign before receiving his dues, if any.

3. Submit the labour form at Tas’heel Centre and attach the receipt with Immigration form and submit at the Immigration counter along with original passport. Labour Card cancellation can be completed at Tas’heel Centre. No need to go to Ministry of Labour.

NOTE: You must cancel your visa in the passport within 30 days from the date of labour card cancellation. You cannot fly before cancelling your visa. 30 days grace period from the date of cancellation counts from the date of Labour Card Cancellation.

4. Original Emirates ID Card should be attached with Cancellation application. If it is lost, IDN Certificate will be accepted. To get IDN Certificate, go to Emirates ID Centre with original passport and they will issue the certificate for free of charge.

NOTE: If the applicant has dependents (spouse, children, maid) under his/her sponsorship, their visa must be cancelled before canceling his/her visa in the passport. Or If he has got new Employment Visa/Investor visa offer, he can deposit at immigration office to avoid canceling his dependents visa. Once his new visa stamped. To deposit, the applicant has to take his original passport, cancellation slip of Labour Card, offer letter in Arabic from new sponsor and original passport of dependents to immigration head office in Jaffiliya.

REFUND PROCEDURES

* Take original deposit receipt, your passport and new labour contract to Refund Counter at Immigration Head Office in Jafiliya. If you are an Investor/Partner, show your new visa stamped passport.

* Get no objection for refund seal from the counter and go to Dubai Commercial Bank (next to Immigration building) and collect the cash. Bank will charge as commission.

There are 60 days grace period for Labour Card from the date of expiry, and 30 days grace period for Visa in the passport. Applicant can stay in UAE 29 days from the date of cancellation if his visa was not expired at the time of cancellation. If the cancellation done during the grace period, remaining days will be allowed to stay without fine. If the cancellation done during overstay period, 6 days will be granted from the date of cancellation.

Fine will be calculated for Residence visa overstay if change status inside the country. Fine can be paid at Immigration or Airport at the time of exit.

Six months Ban will be put at the time of Employment Visa cancellation if he/she didn’t complete two years with the sponsor. This ban is applicable for Employment Visa only. Frequently Asked Questions

Q: How much time will be required to resolve the dispute if I approach the Ministry of Labour to cancel my visa, since my employer is refusing to cancel my visa after I gave in my resignation (which he refused to accept) and I will complete my 30 days notice period.

A: If there is no dispute regarding the dues between you and employer, and you are only approaching the Ministry of Labour to cancel your visa upon completion of the notice period, in this case, the cancellation procedures may be completed by the Ministry of Labour within almost two weeks.

Worker gets 30-day grace period after visa cancellation

Q: I came to Dubai on an employment visa in December 2011. However, the company I signed up for was not particularly to my liking and so I told them to cancel my visa. However, I have not been for a medical examination in this time, and the visa too was never stamped on my passport. My questions are: 1. How many days can I stay in the UAE after cancellation of my visa? 2. Shall I attract a one-year ban? 3. Is there any chance to come back on an employment visa after exiting the country in case the Ministry of Labour places a ban on me? Note that I had not started working at the company.

A: The questioner may stay in the country for 30 days after cancellation of his visa. A one-year ban might be imposed if the sponsor has made such a request on the grounds that the questioner has not started work with the company and thus caused a loss to the sponsor. Therefore, in the event of a ban being imposed on the questioner, the questioner may not enter the country on employment visa immediately, but only after finishing the ban (GN).

To change name in Passport, the following procedures to be completed:

1. Application in EAP-I form. All particulars other than name and signature in the application should tally with those in the present passport.

2. Present passport with additional booklets, if any, in original and photocopy of pages 1, 2, last two pages and page containing valid visa.

3. Sworn Affidavit, in the prescribed format, signed by applicant in the presence of Consular Officer for change of name.

4. Paper cuttings, in original, of two leading daily newspapers, notifying the change of name. One daily newspaper should be of the area of applicant’s permanent address in India and another daily newspaper of the area of applicant’s present address. Format of newspaper notification is given below:-

Cheque is proof of money lent


Q: I lent Dh200,000 to one of my friends in November 2008 and got an undated cheque against it from him. After promising me that he would repay the amount for the past two years, he has now refused to do so. Can I initiate a criminal case against him?

A: To initiate a criminal case against the debtor, you have to produce a bounced cheque to the police. Hence, you have to deposit this cheque to your account and if it returns bounced, then you are entitled to report this to the police. Alternatively, you can proceed with a civil suit directly based on the cheque as it is a proof of debt.

Stale cheque

Q: What is the liability of the drawer of a stale cheque in Dubai? Is the drawer obliged to write another cheque in exchange for a stale cheque?

A: Generally speaking, a cheque is given for payment of any underlying transaction. Hence, it is the duty of the drawer to pay the amount either by giving another cheque or by paying in cash.

Furthermore, a stale cheque cannot be deposited in the bank. However, the same stale cheque is still valid for establishing a civil right of claiming the amount of the cheque from the same person.

Thus, you got a right to file a civil case within 15 years against the drawer for the amount of the cheque as per Article 473 UAE Civil Code.

What are the requirements to sponsor child by the mother?

A mother can sponsor her children on Residence Visa if she meets the following conditions:

* Mother shall have a valid Employment visa.

* Marriage Certificate attested by UAE Embassy abroad and the Ministry of Foreign Affairs inside the UAE.

* Birth Certificate of child attested by UAE Embassy abroad and the Ministry of Foreign Affairs inside the UAE.

* NOC in Arabic from husband to sponsor the child by mother. If the husband is out of UAE, NOC has to be attested by UAE Embassy abroad and the Ministry of Foreign Affairs inside the UAE. If the NOC is typed in other than Arabic, it should be translated into Arabic (legal).

* The sponsor’s monthly salary shall be Dh3000 + accommodation or a total of Dh4000 as per an employment contract approved by the Ministry of Labour. The Contract to be attested from Immigration Department on payment of Dh130.
* Government / Semi-government / Free Zone Employees do not need to attest their Salary Certificate.
* Teachers who want to sponsor their children shall be exempted from the salary condition.

* University degree must be attested from UAE Embassy abroad and Foreign Affairs in UAE and to be translated (legal) into Arabic if the applicant’s profession is other than Nurse, Doctor, Engineer or Teacher.

* Tenancy Contract (accommodation rental agreement). It has to be attested through Ejari online system of Real Estate Regulatory Authority (RERA).

* Bank statement of last three months if the applicant’s profession is other than Nurse, Doctor, Engineer or Teacher.

* Husband should not be eligible by salary to sponsor the child. Husband’s Labour Contract to be attached with application if he is inside UAE.

* Mother can sponsor her unmarried daughters and under 18 years old sons, excluding university or college students provided that a certificate proving the same shall be submitted.

* In case of divorced the children custody verdict of a court shall be submitted.

Q: I am living in Abu Dhabi on my company sponsorship. I work as a secretary and earn around Dh15,000. I and my husband are going through the legal formalities for divorce in India. Can I sponsor my children? My son is 15 and daughter is 10. Is it necessary to get divorce and custody, and then apply for visas for my kids or can I apply now before the divorce?

A: According to the Abu Dhabi Government, expatriate women, who work in a “rare or important specialisation, such as engineering, education, nursing or any other profession related to the medical sector, can apply for visas for family members, if her salary is not less than Dh10,000 or Dh8,000 plus accommodation” providing sponsorship requirements are met. Since, your profession does not match the above you should check it with the Department of Naturalisation and Residency Affairs, which may deal with it on a case by case basis.

Generally, a daughter of any age could be sponsored. However, a son could be sponsored only if he is below 18. Furthermore, you will be required to produce either marriage certificate or divorce and custody documents duly attested by the UAE Foreign Ministry. Since the divorce is pending back in India you are not able to produce marriage certificate. Alternatively you have to wait till you can produce divorce and custody document.

Q: I was working in Dubai, for more than six years. Four months ago I went back home on vacation and didn’t return to the UAE due to my father’s illness and also my financial problem. I have a bank credit card and I didn’t pay it to the bank. Now I am unemployed and unable to pay it.
After a month my company called me to come back but I didn’t go due to family and financial problems. My company told me they were going to cancel my visa. My visa also expired on September 2012.
I came to know that the bank filed a police and Interpol case against me and my name is blacklisted and I can’t go back to Dubai or any other Gulf country.

A: If you intend to repay the bank, you may delegate someone to make the repayment to the bank on your behalf and to get clearance from the bank to lift your name from the blacklist and Interpol list. Thus, you may further settle the matter with your company either by returning to work after the bank problem or ask the company to cancel your residence visa legally to avoid violating the Labour Law as well as the law of the Department of Naturalisation and Residence (Dubai General Directorate of Residency and Foreigners Affairs)-GN.

* Application in form EAP – I (External). All particulars in the application should tally with those in the present passport.

* Six recent photos with white background and frontal view (5cmx5cm).

* Current Passport in original with photocopy of page 1, 2, last two pages, any other endorsement pages and page containing valid visa and additional booklets, if any, should be submitted.

* In the case of passports issued by other Passport Issuing Authorities, Personal Particulars Form (in Triplicate with pasted photos).

* A declaratory Court Order (in original with a copy) issued by a First Class Judicial Magistrate in India instructing the Consulate to correct Date/Place of Birth duly attested by the concerned state Home Department.

* Personal appearance of applicant is compulsory to establish physical identity.

Detailed below are the procedures to be followed by the person taking responsibility for repatriation or burial or cremation of a dead body.

General

* All death formalities to be completed at Hospitals, Ministry of Health and Police can be done only on working days i.e. from Sunday to Thursday between 8am and 2pm.

* In Dubai, after office timings and on holidays ‘on call’ service is available on request made on telephone number +97150-7347676

* Services of a Consulate Official for completing death related formalities are available even after office hours everyday including holidays. He can be contacted on mobile number 050-7347676 after office hours and on holidays.

* In cases of deaths at residence or any place other than Hospitals or in Ambulances, take the body of the deceased on an ambulance to the Police Mortuary for forensic examination.

* Get Death Declaration/Notification from the Police surgeon.

* In cases of deaths at Hospitals or in Ambulances, get Death Declaration/Notification from the Hospital authorities. (Bodies are kept in the concerned hospital mortuary).

FORMALITIES AT POLICE STATION (I)

* Report to the local Police Station where the deceased resided with a copy of Death Declaration/Notification, Passport and other identity documents of the deceased.

* In cases of death due to accident, report to the jurisdictional Police Station where the accident happened.

* In cases of death due to ‘unknown’ reasons, the bodies are kept at Police Mortuary for investigation. Further procedures are dependent on forensic report and investigation report from Public Prosecution Department.


FORMALITIES AT AL BARAHA HOSPITAL, HAMRIYA

* Submit Death Notification to Preventive Medicine Section, Ministry of Health at Al Baraha Hospital, Hamriya) for obtaining the Death Certificate (Fee Dh 50).

* Request for English version of the Death Certificate. If the English version is not made available at Al Baraha hospital, Death Certificate can be got translated at CGI during office hours or from any translation office.


FORMALITIES AT LABOUR OFFICE/ DNRD

Get the sponsor’s signature on the visa cancellation form and get the visa cancelled from Labor/Immigration Dept. New Labour office located at Beirut Street, Al Ghusais. Visa cancellation services are available at DNRD Bur Dubai and other branches till 8pm on normal working days. On holidays cancellation is done at Jumeira Immigration Jail upon request.


FORMALITIES AT CGI

Get the passport of the deceased cancelled at the Consulate. For the purpose, bring the following documents:

* Original Passport
Three copies each of

* Passport of the deceased

* MoH death certificate

* Annex -1 Form

* Annex-2 Form

* Two copies of passport of the accompanying person


Letter of authorization from the Next of Kin of the deceased for repatriating/ cremating the body. If the nearest blood relative/spouse is in India, a fax to the Consulate from the relative/spouse of the deceased from home place is required. The text of the letter of authorization should read as follows:

I,(name) understand that my husband/son/father/brother/wife (name and passport no.) has died on (date) at Dubai. I authorize (name of the person), holder of passport number.. for repatriating/ cremating the body.

* If the cause of death is Murder / Accident / Suicide, then a notarized authorization letter/ affidavit from the wife / father / mother is mandatory.

* Letter from the company or sponsor stating that they will carry out the settlement and repatriation procedures.

* Get a death certificate issued from the Consulate which is done on the basis of the Death Certificate issued by the Ministry of Health.

* Get a letter from the Consulate of no objection for transporting/repatriating the body. The Airlines and Indian authorities require this document.

* Get a copy of the Death Certificate issued by the Ministry of Health attested at the Consulate. This is required for insurance claims in India.

FORMALITIES AT POLICE STATION (II)

* Once again report to the police station with the cancelled passport and the documents received from the Consulate.

Collect the following three documents which are issued by the Police Station:

* Letter to the mortuary authorities for releasing the dead body

* Letter to Al Makhtoum Hospital for embalming the dead body

* Letter to Airport authorities permitting repatriation of the dead body. Procedure in case of departure from Sharjah Airport.

FORMALITIES AT AL MAKHTOUM HOSPITAL

In cases where death is due to highly contagious diseases like Hepatitis B&C, Anthrax, Typhus, Plague, Rabies, Viral hemorrhage, Yellow fever, HIV, bodies are not embalmed and have to be disposed locally.

Approach Al Maktoum Medical Fitness Centre, Sonapur with the following documents for embalming:

* Original death certificate with two photocopies

* Letter from the police with no objection for embalming and transportation of the dead body

* Passport/emergency certificate of the deceased after its cancellation from the consulate/embassy

* A copy of the no objection letter from consulate for transporting/repatriating the body and Death registration

* At the counter of the mortuary of embalming hospital, pay a fee of Dh1,010 for embalming, Dh 1200 to 2500 for coffin and Dh110 for Ambulance Services. Get the time for embalming from Al Maktoum Medical Fitness Centre, Sonapur which is fixed depending on the flight departure timings of the accompanying person.

* A minimum of 3-4 hours before the allotted time of embalming, the authorized person along with one more person who carries some identification document should approach the mortuary for receiving the dead body. Bodies can be taken from Police mortuary till 2 pm and from mortuaries of other hospitals till 4 pm.

* In case of children inform the size to the mortuary attendants (0503483990) for them to arrange the correct size of coffin. Coffins are airtight in which dead bodies can be kept up to seven days. It is safe to open the coffin 2 hours before funeral/cremation.

* Once the time of flight departure is given to Makhtoum Hospital, they transport the body to cargo section of the Airport in an ambulance.

After embalming bring the embalming certificate with one photocopy to the Consulate for attestation. The accompanying person should also bring a copy of his Air Ticket (Cargo air fares to India for mortal remains vary from Dh 1200 to Dh 2500 on national carriers).

FORMALITIES AT AIRPORT CARGO

Following documents in original along with 8 photocopies are required at the cargo section:

* Police No Objection for repatriation/transportation of body and its English translation

* Attested Embalming certificate

* Attested Death certificate and its English translation

* Embassy/Consulate certificate Death registration certificate (Annex I)

* Consulate letter authorizing a person

* Cancelled passport of the deceased

* Accompanying person’s confirmed air ticket (2 copies)

* Accompanying persons passport (2 copies)

* At the export counter of cargo section fill up the Airway bill form and give details of the accompanying person and copy of the ticket.

* Collect the bar code sticker identifying the coffin.

* Provide weight and volume of the coffin at counter number 55.

* Along with Airway bill submit 8 sets of the documents to the cargo section. Three sets are returned, one of which is to be submitted on the 2nd Floor New Cargo Complex customs counter for clearance.

* Give the other two sets with original letter issued from Dubai Police to the Police Outpost on the 2nd floor along with the original copy of Police No-objection letter, which is returned back.

* Pay the cargo charges (Air India /Indian Airlines/Express Dh 1300 to Dh 2500 and in other Airlines Dh 3000 to Dh 4000) upon which original airway bill will be issued.

FORMALITIES AT DESTINATION AIRPORT

* Keep all the original documents including airway bill and carry a minimum of 4 extra copies

* On arrival at the destination airport ask for the airlines staff for help in completing the formalities.

* Hand over the original documents to the kin of the deceased.

* If the coffin is to be moved out side the Airport limits obtain a no objection certificate from the Airport Police.

OTHER FORMALITIES TO BE COMPLETED

Visa of dependents

* Get visas of all the dependents who were on the sponsorship of the deceased cancelled.

* In case dependents want to stay on for some pressing reasons like completion of academic year, etc. make a request to the company where the deceased was working for sponsorship. On their security/ guarantee, Immigration department allows dependents to stay till next academic year or till the validity of the visa.

BELONGINGS OF DECEASED

In case belongings of deceased are to be sent to home country a request from the deceased’s employer in the specified format is to be submitted to the Consulate with a list of used items. Upon receipt the Consulate will issue a letter to the Customs Department on the basis of which the relative of the deceased can carry the belongings without any duty.

LEGAL HEIRS CERTIFICATE (LHC)

* In case all family members of the deceased are present approach the ‘Shariah Court’, LHC can be prepared in the presence of two witnesses.

* If the family members are in India, they should obtain LHC from the concerned authority, get the same attested by state home department and Embassy/Consulate of United Arab Emirates followed by UAE Ministry of Foreign Affairs and Indian Embassy/ Consulate. Translation in Arabic to be attested by Ministry of Justice.

ADDITIONAL PROCEDURE IN CASE OF DEATH OF ABSCONDING EMPLOYEE

* Sponsor of an absconding employee surrenders the absconder’s passport to the Immigration Department/Labour Department.

* In case an absconding employee dies, a person duly authorized by his next of kin and/or Consulate for repatriating or cremating the body should approach Immigration department along with his passport, which is retained as security by Immigration.

* Immigration dept cancels the absconder’s visa upon submission of his death certificate and gives back the passport.

* On producing the documents of cremation/repatriation the guarantor’s passport is returned back.

ADDITIONAL PROCEDURE IN CASE OF DEATH OF ILLEGAL IMMIGRANTS
* Obtain an emergency certificate (Outpass) form from the Consulate or download the same.

* Submit the duly filled form with 2 photographs, copy of passport and/or other Identity documents like Labour Card, Health Card, and Driving License etc of the deceased.

* If no identity documents are available, obtain a letter from the local authorities at the native place of the deceased like Tehsildar or Sarpanch of the local Panchayat stating that the person belonged to the place. Else the Next of Kin can give a duly notarized affidavit along with duly attested photograph of the deceased on the affidavit.

ADDITIONAL PROCEDURE IN CASE OF DEPARTURE FROM SHARJAH AIRPORT

* Get a letter from Dubai Police addressed to Sharjah Police instead of to Dubai Airport.

* Hand over this letter at Sharjah Police Hqrs (situated near the Clock tower) between 8am and 8pm.

* Collect the letter issued by Sharjah Police Head Quarters for Police Outpost at the Sharjah Air Port. Submit this letter along with copies of all other documents at Sharjah Air port Police Outpost. All documents will be retained except the letter from Sharjah Police.

* Fax or bring this letter to Al Medical Fitness Centre on the basis of which they will dispatch the coffin to Sharjah Airport Cargo. One relative should accompany the Ambulance.

PROCEDURE IN CASE OF UNACCOMPANIED MORTAL REMAINS

* It is possible to send unaccompanied remains to any destination point in India.

* Next of kin of deceased sends a notarized confirmation for collection of the body to the respective Airline cargo office at the destination Airport.

* The Airline cargo office in turn sends a message to their City Office at the departure port or to the airport cargo office in UAE. If the message is sent to airport cargo office ensure that a copy is sent to the Airline City Office also.

* Mail or courier all the documents and airway bill to the relatives at the destination who can then approach their concerned airport cargo office, complete the formalities and collect the body.

PROCEDURE IN CASE OF INDIGENT FAMILIES

* If the deceased was not on a Company sponsorship and if his family is indigent make a request to the Labour and Welfare Section at the Consulate for free of cost repatriation of dead body.

* Collect the letter issued by the Consulate for the concerned Airline office.
Submit the letter to the airline office which in turn will issue another letter for the cargo section and give a one-way ticket for the accompanying person and carry the body for free.

PROCEDURE FOR LOCAL DISPOSAL OF DEAD BODY CREMATION OF HINDUS

* Mortal remains of deceased who were holding residence/visit/transit/tourist visa issued from Dubai/Sharjah can be cremated at the Hindu Crematorium in Dubai/Sharjah.

* Get a notarized authorization from the Next of Kin of deceased consenting for local cremation.

* Pay the Municipal fee at Al Quoz / Sonapur

* Approach the local Police Station along with your original passport which will be kept as a guarantee and get no-objection letters for the Municipal Cemetery and mortuary.

Following documents are required at the crematorium for cremation:
* Receipt of the fee paid at the Municipality.

* Copy of the Consulate Annex 1 & 2.

* Copy of the Translated Death Certificate issued by MoH.

* Copy of the visa page of the passport of the deceased.

* Passport copy of the person authorized by the NoK of the deceased.

* Consent letter to the Custodian of the cremation yard. Mr. Sunil (0505071640) or Mr. Eeshwar (050-4549615/04-3532320) are the custodians.

* Pay cremation fees – and another refundable deposit for collection of ashes.

* Relatives can bring Pundits (050-6742362, 050-6742362) from the temple for performing rituals. Puja items have to be brought along.

* Collect ashes in a container within 24 hrs of cremation or else it will be disposed off. Cover container with a white cloth and get it sealed in front of a Consulate official at the Consulate.

* Get the authorization letter from the Consulate for sending the ashes to India for further rites.

BURIAL OF MUSLIMS

Procedures are same as for cremation of Hindus except that no municipal fee is to be paid.

he Federal Labour Law no. 8 of 1980, article 149 states the following: “Where a worker dies as a result of an employment accident or an occupational disease, the members of his family shall be entitled to compensation equal to his basic remuneration for 24 months: Provided that the amount of compensation shall not be less than Dh18,000 or more than Dh35,000. The amount of compensation shall be calculated on the basis of the last remuneration received by the worker before his death. The compensation shall be distributed among the deceased worker’s dependants in the accordance with the provisions of schedule 3 attached to this Law.

For the purpose of the provisions of this article the expression “deceased worker’s family means such of the following persons as were wholly or principally dependent for their subsistence on the deceased worker’s income at the time of his death;

A. the widow or widower;

B. the children, namely

1- sons who are under 17 years of age, and also sons who are regularly enrolled in educational institutions and are under 24 years of age or who are mentally or physically incapacitated for earning a living. The term “sons” includes the sons of the husband or of the wife who were in the deceased worker’s care at the time of his death;

2- unmarried daughters, which term includes unmarried daughters of the husband or of the wife who were in the deceased worker’s care at the time of his death;

C the parents;

D The brothers and sisters, subject to the conditions prescribed for sons and daughters.”

How can I apply residence visa for my parents?

Required Documents

* Passport copies of parents and one photo with white background

* Passport copies of sponsor and spouse with valid visa page

* Monthly Salary should be Dh10,000 or 9,000 + Accommodation

* Visa application charge + service.

* Bank Account Statement for the last Three months.

* For Partner/Investor visa holders, Company and Personal Account Statements for the last three months to be attached.

Tenancy Contract (consisting of Two Bedrooms). It has to be attested through Ejari online system of Real Estate Regulatory Authority (RERA).

* Original Electricity Bill for the last month.

* Labour Contract to be attested from Immigration on payment.

* If the Applicant is a Government / Semi-government or Free Zone Employee, Salary Certificate does not need to attest.

* Should bring both of parents, otherwise attested death/divorce certificate or any other reason to be submitted. Such certificate must be attested from UAE Embassy in home country and Foreign Affairs in UAE. For attestation requirements please call +97150-7447833

* Parents should be in UAE on Visit/Tourist visa while applying residence visa for them.

* Affidavit letter (Dependency Certificate) attested from Consulate stating that you will take care for the sponsored parents and be responsible for their well being.

* Deposit which is refundable after cancellation and exit.

STEPS TO FOLLOW
1. Type Entry permit residence visa application from typing centre and attach above mentioned documents and submit at the Humanitarian Case counter of the Immigration head office in Jafiliya.

2. If the documents are complete, they will give a token with reference number. After three working days you will receive an SMS either accepted or rejected.

3. If the application is accepted, you have to pay as deposit for each parent and Dh530 to issue visa inside country for each.

4. Type Status Change form for typing extra and submit at any of the Immigration counter before the expiry date of Visit Visa/Tourist Visa.

5. Medical, Emirates ID and visa stamping to be completed within 60 days from the date of Status Change.

6. Parents’ visa will be stamped for one year and to be renewed every year.

7. Visa stamping.

NOTE: Profession/Designation of the sponsor matters now to get parents’ visa. Managerial and executive professions are accepted.

NOTE: It is not allowed to combine between the parents and parents-in-law, means should choose either parents or parents-in-law.

Who are eligible for cancellation of ECR Status:-

a. All holders of Diplomatic/official passports.

b. All Gazetted Government Servants.

c. All Income-Tax payers (including Agricultural Income-Tax Payees) in their individual capacity. Proof of assessment of Income-Tax and actual payment of Income Tax for last one year or copy of PAN card to be insisted upon, and not merely payment of advance tax. FAQ: I don’t have ECNR stamp in my Passport. Can I get it on the basis of my provisional matriculation or above certificate issued by the University/Board concerned?

*Ans. ECNR stamp is no longer affixing in passports. In fact it is not even printed in the new passport booklets. Currently, only ECR stamp is being put in passports if applicant is not eligible for ECNR. However, you are entitled to ECNR status if you possess qualification of Matriculation or above. Even you can get ECNR status on the basis of provisional matriculation certificate if the mark sheets of all semesters of your course are available with you. To start an industrial project in the UAE or to effect any changes to an on-going project, the owner or proprietor must obtain a license from the Ministery of Finance and Industry. All industrial projects are governed by Act Number 1 of 1979 and subsequent Ministerial orders. In principle, a license for an industrial project is granted to a UAE national. However, licenses may be granted to applicants of other nationalities under circumstances to be considered by the Minister of Finance and Industry, provided that the chairman of the project and his deputy are UAE nationals and that the company implementing the project is incorporated pursuant to the laws applicable in the UAE, ie, the Commercial Companies Act. If the applicant is a natural person who is a party to a project with a company incorporated as above mentioned, the Minister may determine the size or proportion of investment to be contributed by such person, provided his contribution is not less than 51 per cent.

An application to establish an industrial unit or project must be made to the Ministry of Finance and Industry, addressed to the Advisory Industrial Committee, in the form designated by the Ministry. Such an application must include:

* Name of the applicant and the trade name of the project;

* Legal form of the project, whether it is a limited liability company or otherwise, capital, and distribution of shares;

* Total cost of the project, necessary equipment, and number of laborers required;

* Annual production when the project comes into full operation;

* Production cost;

* Expected income per month;

* Markets where the products are expected to be sold; and

* Privileges and exemptions required to be granted.

The application must be accompanied by the following documents:

* Feasibility study;

* Approval of the local authority, ie, the Department of Economic Development in the respective Emirate;

* Map of the site allocated to the project;

* Memorandum and articles of association of the company, if the applicant is a company incorporated in the UAE, and a copy of its trade license or a copy of passport of the proprietor, if the applicant is an individual; and

* Letter from a bank operating in the UAE, evidencing the financial ability of the project’s owner.

The applicant must begin establishing the project within six months from the date of approval by the Ministry; otherwise, it will be canceled unless there are justified reasons for the delay.

Incentives

Certain privileges and exemptions may be granted to an industrial project, including:

* Allocation of building site for the project either free or on lease basis;

* Rental of necessary industrial buildings for the project in the industrial areas established by the government;

* Supply of electricity and water with normal charges;

* Exemption from custom import duties on import of machinery, equipment, spare parts, and raw materials necessary for running the project;

* Exemption of locally made products from export duties and taxes; and

* Exemption from tax on profit, capital, and income.

National products have priority in government purchases if they are competitive with similar foreign products in quality and price.

Q: I am a Muslim woman; two months ago, my spouse died in Dubai. I have two sons as well as my spouse’s father and mother. My question here is who is the rightful heir of my husband’s legacy and what is the court procedure and duration? Are my spouse’s parents entitled to inherit from the husband’s fortune? Please advise in this regard. ??

A: The questioner shall ask the Sharia Court to issue a Decree of Distribution, as the questioner shall provide two Muslim witnesses before the court, who are required to be aware of the deceased person and his family members so as to explain to the Sharia Court who the deceased’s relatives are. Therefore, the court will issue a Doctrinal Certificate within two days from the date of application in which it will state the rightful heirs of the deceased. As for the question on the deceased parents’ right of legacy, in accordance with the Islamic Sharia, the deceased’s parents inherit along with the questioner and her two sons (GN).

In Dubai, the authorities have deliberately sought to create an environment which is well ordered without being unduly restrictive. As a result, Dubai offers businessmen operating conditions that are among the most liberal and attractive in the region.

There are many options open to international companies seeking to establish a business relationship with Dubai.

Having a presence can provide considerable business advantages in the Middle East. Businessmen in the region prefer to deal with someone they know and trust and personal relationships are much more important in doing business in the Arab world than they are in western Europe or America.

Licensing

The basic requirement for all business activity in Dubai is one of the following three categories of licences:

Commercial licences covering all kinds of trading activity;
Professional licences covering professions, services, craftsmen and artisans;
Industrial licences for establishing industrial or manufacturing activity.

These licences are all issued by the Dubai Department of Economic Development. However, licences for some categories of business require approval from certain ministries and other authorities: for example;

* Banks and financial institutions from the Central Bank of the UAE;

* Insurance companies and related agencies from Insurance Authority;

* Manufacturing from the Ministry of Finance and Industry;

* Pharmaceutical and medical products from the Ministry of Health;

* Contracting and Building Maintenance and some other activities from Municipality (click here for the list of activities required Municipality Approval);

* Transportation and vehicle rental activities from Road and Transport Authority (click here for the list of activities required RTA approval);

* Printing, publishing and advertising activities from National Media Council;

* Cargo Clearing, Cargo packaging, Canal dredging contracting and Fishing cages manufacturing activities from Dubai Maritime City;

* Travel and tourism activities from Department of Tourism and Commerce Marketing (DTCM).

* Gymnasium Club activity from Dubai Sports Council.

* Social Club registration and licensing to be completed from Community Development Authority.

* Tents, awnings and Tarpaulin manufacturing from Environment Protection Section of Dubai Municipality.

More detailed procedures apply to businesses engaged in oil or gas production and related industries.

Practicing some trade activities (e.g. jewellery and insurance) requires the submission of a financial guarantee issued by a bank operating in Dubai.
In general, all commercial and industrial businesses in Dubai should be registered with the Dubai Chamber of Commerce and Industry.


Ownership Requirements

Fifty-one per cent participation by UAE nationals is the general requirement for all UAE established companies except:

* Where the law requires 100% local ownership;

* In the Jebel Ali Free Zone;

* In activities open to 100% AGCC ownership;

* Where wholly owned AGCC companies enter into partnership with UAE nationals;

* In respect of foreign companies registering branches or a representative office in Dubai; In professional or artisan companies (eg. consulting, educational service) where 100% foreign ownership is permitted.

Legal Structures for Business

In the past, each emirate followed its own procedures governing the operations of foreign business interests. In practice, however, Dubai and the other emirates followed the same general system, whereby foreign companies operated in one of three ways: with a local sponsor, through a partnership with a UAE national or company, or through a private limited company or public shareholding company incorporated by Ruler’s decree.
Since 1984, steps have been taken to introduce a codified companies law applicable throughout the UAE. Federal Law No. 8 of 1984, as amended by Federal Law No. 13 of 1988 – the “Commercial Companies Law” – and its by-laws have been issued. In broad terms the provisions of the Law are as follows:
The Federal Law stipulates a total local equity of not less than 51% in any commercial company and defines seven categories of business organisation which can be established in the UAE. It sets out the requirements in terms of shareholders, directors, minimum capital levels and incorporation procedures.
The seven categories of business organization defined by the law are:

* General partnership company

* Partnership-en-commendam

* Joint venture company

* Public shareholding company

* Private shareholding company

* Limited liability company

* Share partnership company

Limited Liability Companies
A limited liability company can be formed by a minimum of two and a maximum of 50 persons whose liability is limited to their shares in the company’s capital. Such companies are recognised as offering a suitable structure for organisations interested in developing a long term relationship in the local market.

In UAE, The minimum capital requirement law was abolished on 10th August 2009. While foreign equity in the company may not exceed 49%, profit and loss distribution can be prescribed. Responsibility for the management of a limited liability company can be vested in the foreign or national partners or a third party.

The following steps are required in establishing a limited liability company in Dubai.

Select a commercial name for the company and have it approved by the Licensing Department of the Economic Department; Get initial approval for the activity from Economic Department;
Draw up the company’s Memorandum of Association and have it notarised by a Notary Public in the Dubai Courts;
Seek approval from the Department of Economic Development and apply for entry in the Commercial Register;
Once approval is granted, the company will be entered in the Commercial Register and have its Memorandum of Association published in the Ministry of Economy and Commerce’s Bulletin. The licence will then be issued by the Department of Economic Development; The company should then be registered with the Dubai Chamber of Commerce and Industry.

Note: Trade Names that cannot be reserved: Name of country, Name of Continent, Famous regions and Towns, Coloure (blue, red etc.).
Foreign words and short words will be charged extra fee of Dh2000 per year.

Branches and Representative Offices of Foreign Commercial Companies
The Commercial Companies Law also covers the formation and regulation of branches and representative offices of foreign companies in the UAE and stipulates that they may be 100% foreign owned, provided a local agent is appointed.

Only UAE nationals or companies 100% owned by UAE nationals may be appointed as local agents (which should not be confused with the term “commercial agent”). Local agents – also sometimes referred to as sponsors — are not involved in the operations of the company but assist in obtaining visas, labour cards, etc and are paid a lump sum and/or a percentage of profits or turnover. In general, branches and offices of foreign commercial companies are not licensed to engage in importing activity except for re-export or in the case of products of a highly technical nature.

To establish a branch or representative office in Dubai, a foreign commercial company should proceed as follows:
Apply for a license from the Ministry of Economy and Commerce, submitting an
agency agreement with a UAE national or 100% UAE owned company. Before
issuing the licence, the Ministry will: forward the application to the Department of Economic Development to obtain the approval of the Dubai government;
forward the application specifying the activity that the office or branch will be
authorised to undertake in the UAE, to the Federal Foreign Companies Committee for approval; Once this has been done, the Ministry of Economy and Commerce will issue the required Ministerial licence specifying the activity to be practiced by the foreign company; The branch or office should be entered in the Economic Department’s Commercial Register, and the required licence will be issued; The branch or office should also be entered in the Foreign Companies Register of the Ministry of Economy and Commerce; Finally the branch or office should be registered with the Dubai Chamber of Commerce and Industry. read more

Branches and Representative Offices of Foreign Professional Companies
Branches and representative offices of foreign professional firms may be 100% foreign owned provided UAE nationals or 100% UAE owned companies are appointed as local agents. Such agents are not involved in the operations of the firm but assist in obtaining visas, labour cards etc and are paid a lump sum as remuneration. The Department of Economic Developmentt is the authority in charge of licensing such branches or representational offices. read more

Professional Firms

In setting up a professional firm, 100% foreign ownership, sole proprietorships or civil companies are permitted. Such firms may engage in professional or artisan activities but the number of staff members that may be employed is limited. A UAE national must be appointed as local service agent, but he has no direct involvement in the business and is paid a lump sum and/or percentage of profits or turnover. The role of the local service agent is to assist in obtaining licences, visas, labour cards, etc.

Setting up Business in the Jebel Ali Free Zone

The Jebel Ali Free Zone was established in 1985 with the specific purpose of facilitating investment. Accordingly, the procedures for setting up in the zone are relatively simple.
While Jebel Ali was established to complement and contribute to Dubai’s growth and development, its legal status is quite distinct. Companies operating there are treated as being “offshore”, or outside the UAE for legal purposes.
The option of setting up in Jebel Ali is therefore most suitable for companies intending to use Dubai as a regional manufacturing or distribution base and where most or all of their turnover is going to be outside the UAE.
Jebel Ali Free Zone Incentives
100% foreign ownership;
Exemption from all import duties;
100% repatriation of capital and profits;
Freedom from corporate taxation, as applied throughout Dubai, with the added bonus of a renewable 15 year guarantee in the Free Zone; Abundant inexpensive energy; Simple and efficient recruitment procedures ensuring the availability of a competitive skilled and experienced workforce;
A high level of administrative support from the Free Zone Authority.

Licences

Companies approved for operation in Jebel Ali Free Zone will be granted one of the following types of licences: Trading, Industrial, Service or National Industrial. These licences are renewable annually for as long as the company holds a valid lease from the Free Zone Authority.
Trading licences will be granted to companies holding a valid licence issued by the Dubai Economic Department or an equivalent authority in the UAE, and to companies incorporated outside the UAE. In each case, the permitted activities on the Free Zone licence must conform to those on the existing licence. Trading licences are also issued to Free Zone Establishments (FZE).
Industrial licences are issued to companies incorporated outside the UAE and to Free Zone Establishments.
Service licences are only granted to companies holding a valid UAE licence.
National Industrial licences are issued to industrial companies registered within or outside the UAE, provided they meet the conditions of having at least 51% AGCC equity and their local production accounting for at least 40% value added. Such companies must obtain the provisional approval of the UAE Ministry of Finance and Industry. A National Industrial licence grants its holder the same rights as those of national and AGCC companies, and products exported to AGCC states will be exempted from customs duties.

If a company wishes to practise more than one of the above mentioned activities, it must obtain a separate licence for each category of activity.
Companies holding a Free Zone licence are permitted to operate in the Jebel Ali Free Zone and outside the UAE. Operation within the UAE can be undertaken either by a commercial agent, representative, distributor, or the mother company licensed by the relevant UAE authority. Any company holding a Free Zone licence can itself purchase goods or services within the UAE. read more

Setting Up a Branch of a Foreign Company

Any company wishing to set up a project in Jebel Ali Free Zone must first complete a simple questionnaire. From the information provided, the Free Zone Authority can make a first assessment of whether the company’s needs can be met.
After consideration of this questionnaire, the company will be provided with:
A licence application including an appendix with details of the documents required concerning the company’s legal status;
A proforma of information required for planning; and
A consumer request for electricity supply.

On receipt of these documents, the Free Zone Authority will consider the proposal. If provisional approval is given, the company will be asked to prepare and submit the documents called for in the appendix to the licence application.
After the checking of these documents, a meeting will be called to discuss and finalise the project details. If everything is satisfactory, the Authority will issue conditional approval for the project. Thereafter, a lease agreement and, if required, a personnel secondment agreement will be prepared by the Authority for signature by the company.

At the time of signing, the applicant will be required to provide the insurance policies called for in the agreements and should pay the agreed rental and licence fee prior to collection of the licence.

If the company wishes the Free Zone Authority to sponsor employees on its behalf, applications for entry permits may be submitted once the licence has been issued. The bank guarantee called for in the personnel secondment agreement will be required at this stage together with visa charges.

If the company’s project involves the erection of a structure, detailed plans must be submitted after the lease has been signed. When the plans have been agreed, a building permit will be issued.

Administrative work, such as importing equipment or engaging labour for installation of equipment, may proceed in parallel with construction work. But application for entry permits for operatives to be sponsored by the Free Zone Authority will not normally be accepted until a completion certificate for the construction has been issued.

Joint Venture Companies

A joint venture is a contractual agreement between a foreign party and a local party licensed to engage in the desired activity. The local equity participation in the joint venture must be at least 51%, but the profit and loss distribution can be prescribed. There is no need to license the joint venture or publish the agreement. The foreign partner deals with third parties under the name of the local partner who – unless the agreement is publicised – bears all liability.

In practice, joint ventures are seen as offering a suitable structure for companies working together on specific projects.

Public and Private Shareholding Companies

The Law stipulates that companies engaging in banking, insurance, or financial activities should be run as public shareholding companies. Foreign banks, insurance and financial companies, however, can establish a presence in Dubai by opening a branch or representative office.

Shareholding companies are suitable primarily for large projects or operations, since the minimum capital required is Dh. 10 million (US$ 2.725 million) for a public company, and Dh. 2 million (US$ 0.545 million) for a private shareholding company. The chairman and a majority of directors must be UAE nationals and there is less flexibility of profit distribution than is permissible in the case of limited liability companies.

Setting Up a Free Zone Establishment

A Free Zone Establishment – or FZE – is an establishment formed and registered in Jebel Ali and regulated solely by the Free Zone Authority.
Such establishments must have a capital of at least Dh 1 million and liability will be limited to the amount of paid-up capital. A FZE need only have a single shareholder and is an independent legal entity.

Any company, organisation or individual wishing to form a Free Zone Establishment must submit a completed application form to the FZE Department of the Free Zone Authority. A decision on whether permission has been granted will be given within 30 days of receipt of the application and any other information and documentation required.

If permission is granted, the Authority will record all relevant details in the FZE Register and issue a Certificate of Formation. This will specify the date of registration after which the FZE will be free to conduct any such business as is permitted in its Special Licence.

NOTE: GCC nationals can set-up business in Dubai without local partner as a sole proprietorship. Partnership with foreigners is subject to the following conditions:

GCC nationals and foreigners can form partnerships without Emirati sponsorship

Dubai has allowed partnerships between GCC investors and foreigners without Emirati sponsorship, on condition that investors finance projects through capital inflows. GCC nationals can have foreign business partners without third local party in Dubai for any project worth a minimum of Dh10 million and based on foreign knowledge and finance.

Investments should come under the categories of enabled sectors like industrial, services, tourism or other businesses that add critical value to the emirate’s economy.

Another compulsory condition for this new initiative is that investors move the business headquarters to Dubai and engage experienced professionals. One more of these businesses conditions is there should focus on the quality of the employees rather than quantity. All workers should fall under the skilled worker category.

However, such new businesses can’t be set up before submitting a concrete business proposal to be approved by the DED committee.

Approvals for starting these businesses is speedy and won’t take more than two weeks.

Limited-Liability Company (LLC)

 

In a limited-liability company, the minimum number of shareholders is two and the maximum is 50. The liability of shareholders is limited to their shares in the capital. The company may carry on any type of activities except insurance, banking, or money investment. In UAE, The minimum capital requirement law was abolished on 10th August 2009. The memorandum of association must include the following:

Trade name of the company, its objectives, head office, duration, names of shareholders, their nationalities, addresses, and places of residence; and Amount of capital, share of each shareholder, and a statement of capital paid in kind (if any), names and nationalities of the company managers, distribution of profits and losses which may not necessarily be in the same proportion as the capital, and the adopted method of notification.

In Dubai, Capital Deposit rule has been cancelled. i.e. Limited Liability Company can be formed without Bank Deposit Certificate and Auditor Certificate. In Abu Dhabi, minimum capital requirement is Dh150,000. The manager of the company will be allowed to operate the account as soon as the incorporation is completed. The Manager of the company can be more than one and he/they shall have all administrative and financial powers. A shareholder may transfer his share in the company or part of it to another shareholder or to a third party. Management is handled by no more than five designated managers, who are not necessarily members of the company. Non-UAE nationals may own up to 49 per cent of an LLC.

In distribution of profit and loss, foreign investor can have 80% and 20% local UAE sponsor.

It is imperative that each limited-liability company appoints auditors to satisfy the requirements of the Commercial Companies Act. The law does not permit this form of company to issue share certificates. Special approval required for certain business activities from the concerned authorities

The new decisions of the Ministry of Labour indeed entitles the employee who completed two years in service with the employer to transfer to a new employer without the need for No Objection Certificate but for this purpose it required that the contract shall be for unlimited period. But if the contract is for a limited period, the employee must not break the contract before the term, otherwise, he shall lose his labour rights. Besides, the employer would be entitled to apply for the Ministry of Labour to impose a one-year ban on the employee.

A limited contract cannot be terminated before completion

Q: My wife has been working in a ladies saloon for almost four years under a contract for limited period which expires next year, she is on my sponsorship. My questions here are; Can my wife leave work immediately or by giving three months notice to the company as per the side contract not labour contract? The side contract mentions three months notice. If the company does not accept the resignation, will the Ministry of Labour impose a work ban on my wife, though she is under my sponsorship? Is it a must to work during the notice period in a limited contract? Please advise.

A: I would like to clarify to the questioner that his wife is working on a contract for a limited period and if the contract is terminated pre-term, she will lose her labour rights except the right related to leave only.Also, the wife might be requested to compensate the employer an amount equivalent to a salary of 45 days if the employer proves that he suffered a loss or was affected by such behaviour.

Finally, the employer might request the Ministry of Labour to impose a one-year ban on the wife due to this violation even if the wife is not under the company’s sponsorship and finally there is no notice period in a limited contract.

Breaking a limited contract

Q: I am working in Sharjah under a two-year limited contract. Recently, I was offered a job in a Dubai-based company and they want me to join by next month. Can I resign before end of the contract?

A: As per Article 116 of the UAE Labour Law, you shall be required to compensate your employer for any loss he may sustain as a result of the termination of the contract, provided that the amount of compensation shall not exceed half the workers remuneration for three months or the residual period of the contract whichever is shorter unless the contract contains a provision to the contrary. Therefore, you need to inform your employer in advance that you wish to resign.
However, the employment agreement, according to Article 113, can be terminated only by both parties’ acceptance. This can be done through submitting a resignation to the employer and giving a notice period of 45 days.

In Dubai, the authorities have deliberately sought to create an environment which is well ordered without being unduly restrictive. As a result, Dubai offers businessmen operating conditions that are among the most liberal and attractive in the region.

There are many options open to international companies seeking to establish a business relationship with Dubai.

Having a presence can provide considerable business advantages in the Middle East. Businessmen in the region prefer to deal with someone they know and trust and personal relationships are much more important in doing business in the Arab world than they are in western Europe or America.

Licensing

The basic requirement for all business activity in Dubai is one of the following three categories of licences:

Commercial licences covering all kinds of trading activity;
Professional licences covering professions, services, craftsmen and artisans;
Industrial licences for establishing industrial or manufacturing activity.

These licences are all issued by the Dubai Department of Economic Development. However, licences for some categories of business require approval from certain ministries and other authorities: for example;

More detailed procedures apply to businesses engaged in oil or gas production and related industries.

Practicing some trade activities (e.g. jewellery and insurance) requires the submission of a financial guarantee issued by a bank operating in Dubai.
In general, all commercial and industrial businesses in Dubai should be registered with the Dubai Chamber of Commerce and Industry.


Ownership Requirements

Fifty-one per cent participation by UAE nationals is the general requirement for all UAE established companies except:

* Where the law requires 100% local ownership;

* In the Jebel Ali Free Zone;

* In activities open to 100% AGCC ownership;

* Where wholly owned AGCC companies enter into partnership with UAE nationals;

* In respect of foreign companies registering branches or a representative office in Dubai; In professional or artisan companies (eg. consulting, educational service) where 100% foreign ownership is permitted.

Legal Structures for Business

In the past, each emirate followed its own procedures governing the operations of foreign business interests. In practice, however, Dubai and the other emirates followed the same general system, whereby foreign companies operated in one of three ways: with a local sponsor, through a partnership with a UAE national or company, or through a private limited company or public shareholding company incorporated by Ruler’s decree.
Since 1984, steps have been taken to introduce a codified companies law applicable throughout the UAE. Federal Law No. 8 of 1984, as amended by Federal Law No. 13 of 1988 – the “Commercial Companies Law” – and its by-laws have been issued. In broad terms the provisions of the Law are as follows:
The Federal Law stipulates a total local equity of not less than 51% in any commercial company and defines seven categories of business organisation which can be established in the UAE. It sets out the requirements in terms of shareholders, directors, minimum capital levels and incorporation procedures.
The seven categories of business organization defined by the law are:

* General partnership company

* Partnership-en-commendam

* Joint venture company

* Public shareholding company

* Private shareholding company

* Limited liability company

* Share partnership company

Limited Liability Companies
A limited liability company can be formed by a minimum of two and a maximum of 50 persons whose liability is limited to their shares in the company’s capital. Such companies are recognised as offering a suitable structure for organisations interested in developing a long term relationship in the local market.

In UAE, The minimum capital requirement law was abolished on 10th August 2009. While foreign equity in the company may not exceed 49%, profit and loss distribution can be prescribed. Responsibility for the management of a limited liability company can be vested in the foreign or national partners or a third party.

The following steps are required in establishing a limited liability company in Dubai.

Select a commercial name for the company and have it approved by the Licensing Department of the Economic Department; Get initial approval for the activity from Economic Department;
Draw up the company’s Memorandum of Association and have it notarised by a Notary Public in the Dubai Courts;
Seek approval from the Department of Economic Development and apply for entry in the Commercial Register;
Once approval is granted, the company will be entered in the Commercial Register and have its Memorandum of Association published in the Ministry of Economy and Commerce’s Bulletin. The licence will then be issued by the Department of Economic Development; The company should then be registered with the Dubai Chamber of Commerce and Industry.

Branches and Representative Offices of Foreign Commercial Companies
The Commercial Companies Law also covers the formation and regulation of branches and representative offices of foreign companies in the UAE and stipulates that they may be 100% foreign owned, provided a local agent is appointed.

Only UAE nationals or companies 100% owned by UAE nationals may be appointed as local agents (which should not be confused with the term “commercial agent”). Local agents – also sometimes referred to as sponsors — are not involved in the operations of the company but assist in obtaining visas, labour cards, etc and are paid a lump sum and/or a percentage of profits or turnover. In general, branches and offices of foreign commercial companies are not licensed to engage in importing activity except for re-export or in the case of products of a highly technical nature.

To establish a branch or representative office in Dubai, a foreign commercial company should proceed as follows:
Apply for a license from the Ministry of Economy and Commerce, submitting an
agency agreement with a UAE national or 100% UAE owned company. Before
issuing the licence, the Ministry will: forward the application to the Department of Economic Development to obtain the approval of the Dubai government;
forward the application specifying the activity that the office or branch will be
authorised to undertake in the UAE, to the Federal Foreign Companies Committee for approval; Once this has been done, the Ministry of Economy and Commerce will issue the required Ministerial licence specifying the activity to be practiced by the foreign company; The branch or office should be entered in the Economic Department’s Commercial Register, and the required licence will be issued; The branch or office should also be entered in the Foreign Companies Register of the Ministry of Economy and Commerce; Finally the branch or office should be registered with the Dubai Chamber of Commerce and Industry. read more

Branches and Representative Offices of Foreign Professional Companies
Branches and representative offices of foreign professional firms may be 100% foreign owned provided UAE nationals or 100% UAE owned companies are appointed as local agents. Such agents are not involved in the operations of the firm but assist in obtaining visas, labour cards etc and are paid a lump sum as remuneration. Professional Firms

In setting up a professional firm, 100% foreign ownership, sole proprietorships or civil companies are permitted. Such firms may engage in professional or artisan activities but the number of staff members that may be employed is limited. A UAE national must be appointed as local service agent, but he has no direct involvement in the business and is paid a lump sum and/or percentage of profits or turnover. The role of the local service agent is to assist in obtaining licences, visas, labour cards, etc.

Setting up Business in the Jebel Ali Free Zone

The Jebel Ali Free Zone was established in 1985 with the specific purpose of facilitating investment. Accordingly, the procedures for setting up in the zone are relatively simple.
While Jebel Ali was established to complement and contribute to Dubai’s growth and development, its legal status is quite distinct. Companies operating there are treated as being “offshore”, or outside the UAE for legal purposes.
The option of setting up in Jebel Ali is therefore most suitable for companies intending to use Dubai as a regional manufacturing or distribution base and where most or all of their turnover is going to be outside the UAE.
Jebel Ali Free Zone Incentives

Licences

Companies approved for operation in Jebel Ali Free Zone will be granted one of the following types of licences: Trading, Industrial, Service or National Industrial. These licences are renewable annually for as long as the company holds a valid lease from the Free Zone Authority.
Trading licences will be granted to companies holding a valid licence issued by the Dubai Economic Department or an equivalent authority in the UAE, and to companies incorporated outside the UAE. In each case, the permitted activities on the Free Zone licence must conform to those on the existing licence. Trading licences are also issued to Free Zone Establishments (FZE).
Industrial licences are issued to companies incorporated outside the UAE and to Free Zone Establishments.
Service licences are only granted to companies holding a valid UAE licence.
National Industrial licences are issued to industrial companies registered within or outside the UAE, provided they meet the conditions of having at least 51% AGCC equity and their local production accounting for at least 40% value added. Such companies must obtain the provisional approval of the UAE Ministry of Finance and Industry. A National Industrial licence grants its holder the same rights as those of national and AGCC companies, and products exported to AGCC states will be exempted from customs duties.

If a company wishes to practise more than one of the above mentioned activities, it must obtain a separate licence for each category of activity.
Companies holding a Free Zone licence are permitted to operate in the Jebel Ali Free Zone and outside the UAE. Operation within the UAE can be undertaken either by a commercial agent, representative, distributor, or the mother company licensed by the relevant UAE authority. Setting Up a Branch of a Foreign Company

Any company wishing to set up a project in Jebel Ali Free Zone must first complete a simple questionnaire. From the information provided, the Free Zone Authority can make a first assessment of whether the company’s needs can be met.
After consideration of this questionnaire, the company will be provided with:
A licence application including an appendix with details of the documents required concerning the company’s legal status;
A proforma of information required for planning; and
A consumer request for electricity supply.

On receipt of these documents, the Free Zone Authority will consider the proposal. If provisional approval is given, the company will be asked to prepare and submit the documents called for in the appendix to the licence application.
After the checking of these documents, a meeting will be called to discuss and finalise the project details. If everything is satisfactory, the Authority will issue conditional approval for the project. Thereafter, a lease agreement and, if required, a personnel secondment agreement will be prepared by the Authority for signature by the company.

At the time of signing, the applicant will be required to provide the insurance policies called for in the agreements and should pay the agreed rental and licence fee prior to collection of the licence.

If the company wishes the Free Zone Authority to sponsor employees on its behalf, applications for entry permits may be submitted once the licence has been issued. The bank guarantee called for in the personnel secondment agreement will be required at this stage together with visa charges.

If the company’s project involves the erection of a structure, detailed plans must be submitted after the lease has been signed. When the plans have been agreed, a building permit will be issued.

Administrative work, such as importing equipment or engaging labour for installation of equipment, may proceed in parallel with construction work. But application for entry permits for operatives to be sponsored by the Free Zone Authority will not normally be accepted until a completion certificate for the construction has been issued.

Joint Venture Companies

A joint venture is a contractual agreement between a foreign party and a local party licensed to engage in the desired activity. The local equity participation in the joint venture must be at least 51%, but the profit and loss distribution can be prescribed. There is no need to license the joint venture or publish the agreement. The foreign partner deals with third parties under the name of the local partner who – unless the agreement is publicised – bears all liability.

In practice, joint ventures are seen as offering a suitable structure for companies working together on specific projects.

Public and Private Shareholding Companies

The Law stipulates that companies engaging in banking, insurance, or financial activities should be run as public shareholding companies. Foreign banks, insurance and financial companies, however, can establish a presence in Dubai by opening a branch or representative office.

Shareholding companies are suitable primarily for large projects or operations, since the minimum capital required is Dh. 10 million (US$ 2.725 million) for a public company, and Dh. 2 million (US$ 0.545 million) for a private shareholding company. The chairman and a majority of directors must be UAE nationals and there is less flexibility of profit distribution than is permissible in the case of limited liability companies.

Setting Up a Free Zone Establishment

A Free Zone Establishment – or FZE – is an establishment formed and registered in Jebel Ali and regulated solely by the Free Zone Authority.
Such establishments must have a capital of at least Dh 1 million and liability will be limited to the amount of paid-up capital. A FZE need only have a single shareholder and is an independent legal entity.

Any company, organisation or individual wishing to form a Free Zone Establishment must submit a completed application form to the FZE Department of the Free Zone Authority. A decision on whether permission has been granted will be given within 30 days of receipt of the application and any other information and documentation required.

If permission is granted, the Authority will record all relevant details in the FZE Register and issue a Certificate of Formation. This will specify the date of registration after which the FZE will be free to conduct any such business as is permitted in its Special Licence.

NOTE: GCC nationals can set-up business in Dubai without local partner as a sole proprietorship. Partnership with foreigners is subject to the following conditions:

GCC nationals and foreigners can form partnerships without Emirati sponsorship

Dubai has allowed partnerships between GCC investors and foreigners without Emirati sponsorship, on condition that investors finance projects through capital inflows. GCC nationals can have foreign business partners without third local party in Dubai for any project worth a minimum of Dh10 million and based on foreign knowledge and finance.

Investments should come under the categories of enabled sectors like industrial, services, tourism or other businesses that add critical value to the emirate’s economy.

Another compulsory condition for this new initiative is that investors move the business headquarters to Dubai and engage experienced professionals. One more of these businesses conditions is there should focus on the quality of the employees rather than quantity. All workers should fall under the skilled worker category.

However, such new businesses can’t be set up before submitting a concrete business proposal to be approved by the DED committee.

Approvals for starting these businesses is speedy and won’t take more than two weeks.

If you have lost important documents or valuables, or your car/valuables have been stolen, you must notify the police in person, who will try to recover it within 48 hours, failing which they will issue you a formal report, so that you can apply for a replacement document or forward to your insurance company for a claim on your valuables.

Personal belongings include National Identity Card, Health Card, large items of cash, non-UAE Identity Card, and important documents for UAE and non-UAE companies should be reported to the police immediately.

If you are a visitor and you have lost something, just go to the nearest police station. Depending on the item, they will either re-direct you to the police headquarters or investigate directly from their police station. It is important that you notify the police, so that the details of your documents can be entered into official databases to prevent misuse and further loss, if any.

Reporting a lost Passport Documents required

To apply Passport for child whose father/mother is out of India, the parent should attest an Affidavit from Indian Embassy/Consulate authorizing his/her spouse or next kin to apply Passport for child/children.

To make an affidavit, spouse name must be endorsed on applicant’s Passport.

In accordance with the Labour Law if the employee, who is under a contract for unlimited period, wished to submit his resignation from work, in this case, he shall give notice to the employer on the same and shall work within such period if so required by the employer, i.e. the Labour Law obliges the employee to work within such period and the latter is not entitled to refrain from working within such period, otherwise he will be contrary to Labour Law and be subject to penalty, but he may immediately leave work if the employer allowed him to do so. The contract shall remain in force until the end of the notice period in accordance with the article no. 118 of the Federal Labour Law no. 8 of 1980. As per the law, notice period is one month and may be agreed to increase the same and may not decrease it. Finally, in according to the Ministry of Labour’s decisions now applicable, if the employee has completed two years with the existing employer, he may work with a new sponsor without a need for No Objection Certificate from the existing sponsor.

Q: I have been working as an auditor for a private company under an unlimited contract. Now I’ve got a better job and I’ve given the resignation but the company says that I have to give a minimum of three months’ notice as per the offer letter I had signed while joining the firm. There is nothing mentioned about the notice period in the original labour contract which is registered at the Labour Department. Please tell me whether the 30-day notice period is required in my case.
A: Both an employer and employee are entitled, as per Article 117 of the labour law, to terminate the unlimited contract of employment any time, yet with legal and acceptable reasons. However, both parties (employer and employee) are bound to notify each other in writing (notice) at least 30 days before ending their labour relationship, either by termination or resignation.
Such a notice period is an indispensable term whether it is stipulated in the contract of employment or not. In other words, no matter this condition is mentioned in the contract or not, it is applicable and guaranteed by law to protect the rights of both parties.

Reducing notice period against contract

Q: I am working in a company and my labour contract is for three years. My contract is unlimited and I have already completed two years of service. In my contract, it is said that I have to give a three-month notice period before resigning. I am planning to quit. Is it possible to give a one-month notice period? If not, what are the consequences?

A: The established principles of law in the UAE are that the contracting parties must observe all the provisions of the relevant contract and must fulfil their obligations accordingly. Since three months’ prior notice is mentioned in your employment contract, as per the UAE Labour Law, you must give three-month prior notice for resigning the job. Otherwise, you will be held responsible for compensation in lieu of notice as per Article 119 of the UAE Labour Law.
According to the article, “If the employer or the employee has failed to serve notice to the other party for termination of the contract or has reduced the notice period, the party obliged to serve the notice shall pay to the other party an indemnity called “Compensation in lieu of notice”, and the indemnity shall be equal to the employee’s pay for the notice period in full or in proportion to the diminished part” (KT).

Q: I have been working in a foodstuff trading company since 1998. My residence visa was renewed in February 2012, but my labour card is expiring in February 2013 and my job contract is unlimited. Recently, due to some health problems of my father in India, I was unable to continue my work in Dubai, and hence submitted my resignation giving a 30-day notice period, which the company has accepted. I wish to cancel my visa and travel back to India. But the company told me they would impose a one-year ban and recover my salary for 45 days towards my visa renewal charges. Is this legal?

A: It is not legal for your employer to recover the visa’s cost if you have given 30-day prior notice unless otherwise provided in your employment contract.
Under UAE laws, if an employee leaves a job without completing two years, then the Ministry of Labour will impose a work ban for six months or for one year if it is imposed by the company and during that time, the individual is not allowed to work in the UAE. Both these situations are not applicable to you as you have completed 14 years in the same company. Furthermore, a work ban is not applicable if the current or new employer is based in a free zone in Dubai.

According to Articles 144, 145 and 146 of the federal labour law, where a worker meets with an accident during duty or contracts an occupational disease, the employer shall pay for the cost of his treatment in a local government or public medical centre until he recovers or is declared disabled. Treatment shall include residence in a hospital or sanatorium, surgical operations, expenditure on X-rays and medical analyses, the purchase of medicines and rehabilitation equipment and the supply of artificial limbs and other prosthetic appliances for any person who is declared disabled. In addition to what he supplies, the employer shall pay the cost of any transport entailed by treatment provided for the worker.

Additionally, if the injury prevents the worker from carrying out his work, the employer shall pay him a cash allowance equal to his full pay throughout the period of treatment or for a period of six months whichever is shorter.

Moreover, the cash allowance referred to shall be calculated on the basis of the last remuneration received in the case of a worker remunerated on a monthly, weekly, daily or hourly basis.

Article 142 of the same law defines the occupational disease as the diseased listed in Schedules 1 and 2 attached to the labour law.

How can I apply for Police Clearance Certificate in Dubai?

 

Police Clearance Certificate (Good Conduct Certificate) is issued by Criminal Investigation Department (CID) of Police. It is required to get Employment Visa in Government and Semi-Government Departments, Banks, Major Companies, to apply for PRO Card and to migrate to European Countries..etc.

Q: I used to work as a mechanical engineer in a construction company here for four years. My UAE visa is valid till December 2012. I took my annual leave in August 2011 and couldn’t return as I had an accident. I have settled all my dues through my friends. My company has not yet sent me a release. How may I cancel my current visa and can approach another company in the UAE for employment?

A: You have to check whether your current visa has been cancelled or not. If your current visa is not yet cancelled by your employer, you can come back to the UAE on the same visa provided your current employer get approval from the relevant immigration as you have overstayed outside the UAE. After your arrival, you have to give your resignation in accordance with the terms of your employment contract. However, if your visa has been cancelled you can come on a new visa.

Q: My brother-in-law is holding a free zone visa, which will expire soon. He is currently in India and has undergone a surgery for knee replacement due to which he cannot travel back to Dubai before the expiry date. Is there a way where medical papers can be submitted to the immigration authorities to allow him to enter Dubai later?

A: One of the main conditions for renewing the visa is the presence in the country. Hence, if your brother-in-law is not able to come before the expiry of the visa then he can apply for a new visa and submit the old one with the medical reports that proves that he was prevented from entering the country due to his medical condition (KT).

Answer: Power of Attorney can either be on a plain paper or stamp paper as per your requirement or as advised by your lawyer.

Article no. 132 of the Federal Labour Law No. 8 of 1980 states the following: A worker who has completed a period of one or more years of continuous service shall be entitled to severance pay on the termination of his employment. The days of absence from work without pay shall not be included in calculating the period of service. The severance pay is calculated as follows:

1. Twenty-one days’ remuneration for each year of the first five years of service.

2. Thirty days remuneration for each additional year of service provided that the aggregate amounts of service pay shall not exceed two year’s remuneration.

Below is the original text of the UAE Federal Labour Law with the section on gratuity payments. Articles 132, 137, and 138 refer specifically to the calculation of gratuity.

Article 132

A worker who has completed one or more years of continuous service shall be entitled to severance pay at the end of his employment. The days of absence from work without pay shall not be included in calculating the period of service. The severance pay shall be calculated as follows:

21 days’ wage for each of the first five years of service.
30 days’ wage for each additional year of service provided always that the aggregate amount of severance pay should not exceed two year’s wage.
Article 133

A worker shall be entitled to severance pay for any fraction of a year he actually served, provided that he has completed one year of continuous service.

Article 134

Without prejudice to the provisions of laws that grant pensions or retirement benefits to employees in certain firms, severance pay shall be calculated on the basis of the wage last due for monthly, weekly and daily paid workers, and on the basis of the average daily wage referred to in Article 57 hereof for those paid on piecemeal. The wage used as a basis for calculating severance pay shall not include whatever is given to the worker in kind, housing allowance, transport allowance, travel allowance, overtime pay, representation allowance, cashier’s allowances, children education allowance, allowances for recreational and social facilities, and any other bonuses or allowances.

Article 135

An employer may deduct any amounts owed to him by a worker from the latter’s severance pay.

Article 136

For the purposes of Article 132, no severance pay shall accrue for the employment cases that preceded the enforcement of this Law except where the worker is a National. This, however, shall be without prejudice to any rights acquired by the worker under the repealed labour laws, the employment contract, or under any agreement, regulations or work rules of the firm. In the event of the worker’s death, his severance pay shall be paid to his legal heirs.

Article 137

Where a worker under an indefinite term contract abandons his work at his own initiative after a continuous service of not less than one year and not more than three years, he shall be entitled to one-third of the severance pay provided for in the preceding article. Such a worker shall be entitled to two thirds of the said severance pay if his continuous service exceeds three years up to five years, and to the full severance pay if it exceeds five years.

Article 138

Where a worker under a definite term contract abandons his employment at his own initiative before the expiry of his contract period, he shall not be entitled to severance pay unless his continuous period of service exceeds five years.

Article 139

A worker shall forfeit entitlement to his entire severance pay in any of the following two cases:

If he is dismissed from service for any of the reasons specified in Article 120 hereof or if he abandons his employment in order to avoid being dismissed in accordance with that Article.
If he abandons his employment of his own accord, otherwise than in either of the two cases specified in Article 121 hereof, without notice (in the case of indefinite term contracts) or before completing five years of continuous service (in case of definite term contracts).
Article 140

Where a firm has a provident fund for the workers and the rules of the fund stipulate that whatever the employer pays into the fund for the worker’s account is in discharge of his legal obligation in respect of severance pay, the worker shall be paid the savings balance in his account or the severance pay due under the Law, whichever is the greater. Where the rules of the fund do not stipulate that the amounts paid by the employer are in discharge of his legal obligation toward the severance pay, the worker shall receive whatever is due to him in the provident fund in addition to the statutory severance pay.

Article 141

Where a firm has a retirement, insurance or a similar scheme, a worker who is entitled to a retirement pension may opt for treatment under the said pension or severance pay or under the pension or insurance scheme, whichever is more advantageous to him.

How can I endorse spouse name in my Passport?

 

To endorse spouse’s name in the Passport, the following procedures to be completed at Indian Embassy/Consulate:

* Marriage Certificate issued by Registrar of Marriage duly attested by the Home Department of the concerned State in India or Ministry of External Affairs, Delhi with any state home department.

* Marriage Affidavit will not be accepted.

NOTE: MEA additional seal with ‘The Ministry of External Affairs accepts no responsibility for the contents of the above documents’ will not be accepted by the Consulate for this purpose. In that case, concerned state home department attestation is required or attach wife’s passport copy which has already been endorsed spouse name.

Question: Why do I need a sponsorship declaration and what is the procedure to get it attested?

Answer: Sponsorship declaration is required by the Indian Immigration at some of the Indian Airports to support the travel and stay in UAE. The following is required to make a sponsorship declaration:

* Personal presence of the person making the sponsorship declaration.

* Valid passport in original with photocopy (first / last and valid visa page) of the applicant.

* Passport copy of the person who is being sponsored along with the visa copy.

* Proof to show relationship of the person being sponsored with the person making the declaration. (*a lady is not allowed to be sponsored unless she is a wife / dependant daughter / sister of the person sponsoring her).

* Salary certificate of the person sponsoring (English translation of all certificates in Arabic, is mandatory).

* In case the sponsorship declaration is executed for sponsoring the spouse of the executant, copy of the marriage certificate have to be attached.

* All affidavit/declaration/documents made on behalf of wife/children/wifes relatives spouse name needs to be endorsed in each others passport.

A UAE National executing the Sponsorship Declaration, have to produce an undertaking issued by the local court stating that the sponsor will take care of the sponsored person during his / her stay in the UAE. This undertaking has to be attested by the Ministry of Foreign Affairs, Dubai/ Sharjah. The sponsor also has to produce his / her income proof.

Question: How to get an Educational/ Transfer certificate attested?

Answer: Personal presence of the certificate holder or either of the parents incase of a minor at the Consulate with the following documents :

* Valid passport in original of the certificate holder or one of the parent incase of a minor.

* Passport photocopy (first / last and valid visa page) of the certificate holder and one of the parent (in case of a proxy applicant, original passport of one of the parent is required along with the original passport and copy of the proxy applicant).

* Certificates originating from India issued by universities and other Institutions of higher studies have to be attested by:

* Department of Higher Education, Ministry of Higher Education of the same State.

* Consular Section, Ministry of External Affairs, Patiala House, New Delhi

* UAE Consulate in Mumbai or UAE Embassy in New Delhi.

* School certificate up to class XII (higher secondary level) issued by the educational institutions in India, in original and a photocopy, have to be attested by :

* District education authorities of the concerned state / union territory (District Education Officer).

Documents required

* A photocopy of the car registration card (mulikiyya), passport, sale deed (if any) and a letter of complaint in Arabic with all details of the car’s loss/theft.

1. Complaint should be submitted to the nearest police station of the incident or police head quarters. Only the car owner or authorized person can file the complaint.

2. A copy of the car search report will be provided on the next day upon request, which can be submitted to your insurance company.

4. If the car is found, the owner will be notified.

In General

There are two types of courts in the UAE, ie, federal (the Emirates of Abu Dhabi, Sharjah, Fujairah, Ajman, and Umm Al Quwain) and local (the Emirates of Dubai and Ras Al Khaimah, which have retained their independent judiciaries). Both federal and local courts comply with the UAE Temporary Constitution of 1972. Both federal and local court systems are composed of three levels, ie, courts of first instance, courts of appeal, and the Federal High Court in Abu Dhabi or the Court of Cassation in the Emirate of Dubai. In the Emirate of Ras Al Khaimah, the judiciary is of two levels only, ie, courts of first instance and a court of appeal.

The Civil Procedure Act regulates the jurisdiction of the federal courts, their formation, and level in the hierarchy. The Act is applicable to all civil proceedings before the courts, ie, civil, commercial, and personal. Although the courts in the Emirate of Dubai are formed under and regulated by Act Number 3 of 1992, the Civil Procedure Act has been adopted and enforced in Dubai pursuant to Act Number 5 of 1992.

Conciliation and Arbitration

Rules of arbitration and conciliation in commercial matters have been given by the Chambers of Commerce in each of the Emirates. An arbitration award will be enforced by the relevant court of jurisdiction for execution of judgments.

Question: What documents are required to make an undertaking to provide financial support for higher education?

Answer: To provide financial support for higher education the following documents are required ;

* Valid passport in original with photocopy (first / last and valid visa page) of the person pledging financial support.

* Salary certificate in original or labour contract copy.

* Bank statement for last six months.

* Passport photocopy of the student.
